Terms of Service

1. Acceptance of Terms

By creating an account or using Boardy, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years old to use Boardy. If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To use Boardy, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your login credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account

You may not create multiple accounts, use another person's account, or transfer your account to anyone else without our prior written consent.

4. User Content

Ownership: You retain ownership of all content you create and post on Boardy, including reviews, ratings, lists, comments, posts, and uploaded images ("User Content").

License: By posting User Content, you grant Boardy a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your User Content within the App and for promotional purposes related to the App.

Responsibility: You are solely responsible for your User Content. You represent and warrant that your User Content does not violate any third-party rights or applicable laws.

5. Prohibited Conduct

You agree not to:

• Harass, bully, threaten, or intimidate other users
• Post content that is illegal, harmful, defamatory, obscene, hateful, or discriminatory
• Impersonate any person or entity
• Post spam, misleading, or deceptive content
• Attempt to access other users' accounts or private data
• Use bots, scrapers, or automated systems to interact with the App
• Circumvent security measures, rate limits, or access controls
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App for any commercial purpose without our authorization
• Violate any applicable laws or regulations

6. Content Moderation

We reserve the right, but have no obligation, to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. Users can report content or users that violate our guidelines. Repeated or serious violations may result in temporary suspension or permanent termination of your account.

7. Third-Party Services

Boardy integrates with third-party services to enhance your experience:

• Spotify: For accessing your music data, listening history, and playlist management. Your use of Spotify through Boardy is subject to Spotify's Terms of Use.
• Last.fm: For genre browsing and music discovery. Subject to Last.fm's Terms of Service.
• Supabase: For authentication and data storage. Subject to Supabase's Terms of Service.

We are not responsible for the availability, content, or practices of third-party services. You agree that your use of these services is at your own risk.

8. Intellectual Property

Album artwork, artist names, track titles, and music metadata displayed in Boardy are provided by Spotify and Last.fm and belong to their respective owners. Boardy does not claim ownership of this content.

The Boardy name, logo, design, and source code are the property of Boardy and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our prior written consent.

9. Disclaimer of Warranties

Boardy is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Boardy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or service interruptions, arising out of or in connection with your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Boardy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the App, your User Content, or your violation of these Terms.

12. Account Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise detrimental to the App.

You may delete your account at any time through the App settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of Boardy after changes constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of France.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
